After receiving an order on Oct. 10 from Justice Lyn Stuart ordering him to remove his personal belongings from the Alabama Judicial Building, suspended Alabama Chief Justice Roy Moore has refused to clear out his office. The belongings remaining include a grandfather clock and large portraits of George Washington, Abraham Lincoln and the singing of the Declaration of Independence.
Last Friday, Moore’s lawyer Mat Staver filed a motion with the Alabama Supreme Court to revoke the orders in Stuart’s letter and have Justices Stuart, Bolin, Main and Shaw be recused from Moore’s appeal.
“Justice Stuart’s action against me personally and the subsequent firing of the staff attorneys I hired is troublesome, and such actions prejudge the case,” Moore said in a statement released through his lawyer. “Instead of acting as though my appeal has already been decided, I call upon these justices to recuse.”
While the appeal on Moore’s suspension is under way, AL.com reported that eight out of Alabama’s 67 counties are not issuing same-sex marriage licenses as they are still following the judicial orders that earned Moore his suspension.
